Terms of Service

1. Acceptance of Terms

By creating an account or using One Who Learns (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

The Service is operated by maray (Ayk Martirosyan), Lehderstrasse 63, 13086 Berlin, Germany ("we", "us", "our"). These Terms constitute a legally binding agreement between you and us.

2. Description of the Service

One Who Learns is a German vocabulary and language learning platform. It provides AI-generated memory palace scenes, spaced repetition, interactive courses (A1–B1), grammar drills, and vocabulary tools to help English speakers learn German.

The Service includes a free tier and a premium paid tier. Features available under each tier are described on the pricing page and may change over time with notice.

3. Eligibility & Account Registration

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at ayk@maray.ai if you suspect unauthorized access to your account.

You may register using email and password or via Google OAuth. Each person may maintain only one account.

4. Subscriptions & Billing

4.1 Free Tier

The free tier grants access to the A1 course (8 units), the A1 vocabulary deck, spaced repetition, and memory palace images. No payment is required.

4.2 Premium Subscription

Premium subscriptions unlock the A2 and B1 courses, A2/B1 vocabulary lists, AI image generation, AI word auto-fill, CSV import, and other features listed on the pricing page. Premium is available on a monthly (EUR 12/month) or annual (EUR 99/year) basis.

4.3 Billing & Renewal

Subscriptions are billed in advance on a recurring basis through Stripe. Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date. By subscribing, you authorize us to charge your payment method on the applicable renewal date.

4.4 Cancellation

You may cancel your subscription at any time via the subscription management page in Settings. Cancellation takes effect at the end of the current billing period — you retain premium access until then.

4.5 Refunds

Due to the digital nature of the Service, we do not offer refunds for partial billing periods. If you believe a charge was made in error, please contact ayk@maray.ai within 14 days of the charge.

4.6 Price Changes

We may change subscription prices with at least 30 days' notice. Price changes take effect at your next renewal date. Continued use after the effective date constitutes acceptance of the new price.

5. Content & Intellectual Property

5.1 Our Content

All course content, vocabulary data, AI-generated images, mnemonics, audio files, and platform code are owned by or licensed to us. You may not copy, redistribute, or commercially exploit any part of this content without our written permission.

5.2 Your Content

You retain ownership of any custom vocabulary words, notes, or other content you add to the Service ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to store and display that content solely to provide the Service to you.

5.3 AI-Generated Content

Some content — including vocabulary images, mnemonics, and scene descriptions — is generated by AI models. AI-generated content may occasionally be inaccurate, unusual, or imperfect. We do not guarantee factual accuracy of AI-generated content and it should not be used as a sole source for language instruction.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Scrape, crawl, or systematically extract content from the Service without permission
• Upload content that is harmful, offensive, or infringes third-party rights
• Share your account credentials with others or resell access to the Service
• Reverse-engineer or attempt to extract the source code of the platform
• Exceed AI enrichment quotas through automated scripts or circumvent usage limits

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

7. Third-Party Services

The Service integrates third-party providers including Supabase (database & auth), Vercel (hosting), Stripe (payments), Google (OAuth & AI), and PostHog (optional analytics). Your use of the Service is also subject to the applicable terms of these providers. We are not responsible for the conduct or availability of third-party services.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or merchantability. We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.

Language learning results depend on individual effort and are not guaranteed by the use of this Service.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of goodwill, arising from or related to your use of the Service.

Our total liability for any claim arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim, or EUR 100, whichever is greater.

Nothing in these Terms limits liability that cannot be excluded under mandatory German or EU law, including liability for intent or gross negligence.

10. Service Availability & Changes

We may modify, suspend, or discontinue the Service (or any part of it) at any time. We will provide reasonable notice of material changes where possible. Continued use after changes constitutes acceptance of the updated Service.

We reserve the right to update these Terms at any time. Material changes will be communicated by updating the "Last updated" date above and, where appropriate, by email. Your continued use of the Service after changes constitutes acceptance.

11. Account Termination

You may delete your account at any time by contacting us at ayk@maray.ai. Upon deletion, your personal data and learning data will be removed within 30 days in accordance with our Privacy Policy.

We may suspend or terminate your account if you violate these Terms, fail to pay subscription fees, or if we are required to do so by law.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of law provisions. The courts of Berlin, Germany have exclusive jurisdiction over any disputes arising from these Terms or your use of the Service.

If you are a consumer resident in the EU, you may also have rights under the mandatory consumer protection laws of your country of residence, which these Terms do not override.

The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obligated to participate in alternative dispute resolution procedures but are willing to seek amicable solutions.
